Please read these Terms of Service (“Terms”) carefully before using the DmarcAuditor.com website and service (the “Service”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.


1. The Service

DmarcAuditor.com provides a DMARC report monitoring and analysis service. The Service ingests DMARC reports sent to your configured domain’s DNS records, aggregates this data, and presents it through a searchable dashboard for historical analysis. The Service collects all data present in the DMARC reports, including but not limited to IP addresses, sending domains, SPF/DKIM/DMARC authentication results, and email volume.

You acknowledge and agree that the accuracy and completeness of the data presented by our Service are dependent on the DMARC reports themselves, which are generated and sent by third-party mail receivers. We are not responsible for the accuracy, completeness, or timeliness of these third-party generated reports.


2. User Accounts and Registration

2.1. To access and use the Service, you must register for an account. You can register by logging in via your Google or GitHub account, or by receiving a login link via email.

2.2. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.3. You are responsible for safeguarding the password or login link that you use to access the Service and for any activities or actions under your password or login link. We cannot and will not be liable for any loss or damage arising from your failure to comply with these security obligations.

2.4. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2.5. Each individual or entity is permitted to maintain only one free account. You agree not to create multiple accounts to circumvent limitations or exploit the free offering. Violation of this clause may result in the termination of all associated accounts.


3. Data Retention

The Service currently offers a free plan with a 30-day data retention period. This means that DMARC report data older than 30 days will be automatically deleted from your account.


4. Data Privacy and Security

4.1. Data Processing: We collect and process data (including DMARC reports which may contain IP addresses) that you provide or that is generated through your use of the Service. Our servers are located in Germany.

4.2. IP Addresses: You acknowledge that DMARC reports may contain IP addresses that could, under certain legal interpretations (e.g., GDPR), be considered personal data. By configuring your DNS to send DMARC reports to our Service, you grant us a limited, non-exclusive, revocable license to process this data solely for the purpose of providing the Service to you.

4.3. Data Security: We implement industry-standard technical and organizational security measures to protect your data, including encryption at rest and in transit, access controls, and regular backups. While we strive to use commercially acceptable means to protect your data, we cannot guarantee its absolute security.

4.4. Third-Party Services: We use third-party services to operate and improve our Service. These include:

  • Hetzner: For server hosting and infrastructure.
  • Fastmail: For sending customer support emails.

By using our Service, you agree to the processing of your data by these third parties in accordance with their respective privacy policies. We do not share your DMARC report data with any other third parties.

4.5. Privacy Policy: Our Privacy Policy describes how we collect, use, and disclose your personal information. By using the Service, you agree to the terms of our Privacy Policy.


5. User Conduct and Prohibited Uses

5.1. You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Service.

5.2. Prohibited activities include, but are not limited to:

  • Using the Service for any illegal or fraudulent activities, including phishing or spamming.
  • Attempting to reverse engineer, decompile, or disassemble any part of the Service.
  • Attempting to overload, disrupt, or impair the functionality or security of the Service, our servers, or networks.
  • Using the Service for domains that you do not own, manage, or have explicit authorization to monitor.
  • Sharing account credentials with unauthorized individuals.
  • Creating multiple free accounts to circumvent limits or exploit the free offering.

5.3. We reserve the right to investigate and take appropriate legal action against anyone who violates these provisions, including, without limitation, removing the offending content from the Service, suspending or terminating the account of such violators, and reporting them to law enforcement authorities.


6. Intellectual Property

6.1. The Service and its original content (excluding DMARC report data provided by users), features, and functionality are and will remain the exclusive property of The Service and its licensors.

6.2. You retain all ownership rights to the DMARC report data that you send to our Service. You grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display this data solely for the purpose of providing and improving the Service to you.

6.3. We may generate aggregated and anonymized statistical data related to the use of the Service, such as general DMARC adoption trends or common DMARC failure reasons, which does not identify any specific customer data. We retain all intellectual property rights to such aggregated and anonymized data.


7. Disclaimers and Limitation of Liability

7.1. Service Provided “As Is” and “As Available”: The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We make no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, or materials included therein. You expressly agree that your use of the Service is at your sole risk.

7.2. No Guarantee of Uninterrupted or Error-Free Service: We do not warrant that (i) the Service will function uninterrupted, secure, or available at any particular time or location; (ii) any errors or defects will be corrected; (iii) the Service is free of viruses or other harmful components; or (iv) the results of using the Service will meet your requirements or be completely accurate.

7.3. DMARC Report Accuracy: We are not responsible for the accuracy, completeness, or validity of DMARC reports originating from third-party mail receivers. Our Service processes the data as it is received.

7.4. Email Security: While DMARC monitoring can enhance email security, we do not guarantee that the Service will prevent all email impersonation, phishing, or spam attacks.

7.5. Limitation of Liability: * In no event shall the Service, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose. * Our maximum aggregate liability to you for any damages arising out of or related to these Terms or your use of the Service, regardless of the form of action, whether in contract, tort (including negligence), or otherwise, shall be limited to One Hundred U.S. Dollars ($100 USD). This limitation applies even if the remedies available to you under these Terms fail of their essential purpose.


8. Termination

8.1. Termination by You: You may terminate your account at any time by contacting support.

8.2. Termination by Us: We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms or engage in prohibited activities.

8.3. Effect of Termination: Upon termination, your right to use the Service will immediately cease. All your DMARC report data will be deleted after a grace period of 7 days from the date of termination, or immediately if termination is due to a severe breach of these Terms. We may retain basic account information (e.g., email address) for legal and administrative purposes.


9. Governing Law and Dispute Resolution

9.1. These Terms shall be governed and construed in accordance with the laws of Lithuania, without regard to its conflict of law provisions.

9.2. Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or invalidity thereof, shall be finally settled by the courts located in Vilnius, Lithuania.


10. Changes to These Terms

10.1. We reserve the right, at our sole discretion, to modify or replace these Terms at any time.

10.2. For material changes, we will provide at least 30 days’ notice prior to any new terms taking effect, typically via email to your registered address or a prominent notification within the Service or on our website.

10.3. For minor changes or clarifications, these may take effect immediately.

10.4. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
